If the land our ancestors gave us represents a seed, what would its fruit be?

Land is the essential cornerstone of tribal culture and the life of Tribal Nations. It was passed down to us through many generations, at significant cost. This sacred inheritance is crying out to be more deeply rooted into the life and consciousness of its people. It yearns to embark on a journey towards a more profound and visceral union. To engage in a mating dance whose fruit is the economic well-being and true sovereignty of its people.

An essential component of dynamic land stewardship is the principle of highest and best use. This fundamental economic convention defines it as the highest and most profitable use for which the property is adaptable and needed, or likely to be needed in the reasonably near future. Any property that is not functioning at its highest and best use, is a property that is not performing at an optimal level, thus slowing the velocity of its true earning capacity; it is a property being neglected. Appraisers measure this by four distinct criteria: Legal Permissibility, Physical Possibility, Financial Feasibility, and Maximum Productivity. In Native American communities, where the land has a remarkable and distinct public and spiritual dimension, the Communal Benefit of the proposed land use must be an additional consideration.

Because most Tribal Lands are held in trust by the federal government, and to limit its liability as to its 'responsible stewardship' of these lands, the government demands that, for most routine proposed uses, an appraisal be conducted by one of its own Certified General real estate appraisers. Regardless of the merits behind this policy, and despite the best efforts of their dedicated appraisers, its unquestionable effect has been to introduce extensive delays and barriers to the efficient management of Tribal Lands. These delays are an impediment that significantly impact the overall well-being of our communities.
